Evanston developer files for bankruptcy

The developer of the Sienna Condos in downtown Evanston has filed for bankruptcy protection this week, according to an article in the Chicago Real Estate Daily.

According to the report, Thomas Roszak “said he has assets of $1 million to $10 million and liabilities of $50 million to $100 million,” and that seven companies he co-owns filed for Chapter 7 petitions.

Sienna, a four-phase 120-unit development, only completed two phases.  Roszak had filed a request with the city last year to build a hotel and rentals for the final two phases. That request was never pursued.

Afterward, Roszak placed the two remaining lots – 1760 and 1780 Oak –  on the open market for $9,500,000. The property was taken off the market May 31, 2009.

Meanwhile, Illinois Attorney General Lisa Madigan has filed suit against Roszak for failing to comply with accessibility laws in the design and construction of the Sienna condos, according to an article in Evanston Now

The lawsuit claims Roszak targeted potential buyers with disabilities, promising them easy access to the condos.  But the route with easy access for people with disabilities was not finished, the lawsuit alleges.

In May 2007, a 20-foot by 70-foot section of a garage roof collapsed at the site of the Sienna development. No one was injured.
